Nine Antenatal – Terms of Service

These Terms of Service (“Terms”) govern your use of services, classes, digital and physical products, and website content provided by Nine Antenatal (“Nine”, “we”, “our”). By booking a class, purchasing a product, or accessing our materials, you agree to these Terms.

1. Services

Nine provides premium antenatal education for families preparing to birth at Auckland Hospital. Services may include:

  • In-person antenatal classes

  • Virtual follow-up sessions

  • Educational resources (digital and printed)

  • Breastfeeding education

  • Physical products

All educational services are designed to complement — not replace — care provided by your Lead Maternity Carer (LMC), obstetrician, or healthcare provider.

2. Educational Nature & Limitations

All information provided by Nine is for educational purposes only. Attendance or participation does not create a clinical relationship, on-call service, or guarantee specific medical advice.

Participants must consult their own healthcare provider for individual medical decisions.

3. Bookings, Payments & Cancellation

  • Full payment is required to secure any class or product purchase.

  • Bookings are subject to Nine’s Refund & Cancellation Policy.

  • Nine reserves the right to refuse, cancel, or reschedule bookings at its discretion.

4. Intellectual Property

All content, including class materials, slides, digital downloads, written resources, branding, and frameworks, remains the exclusive property of Nine.

You may not:

  • Copy, reproduce, distribute, or share materials

  • Record or publish any content without written consent

  • Use content for commercial purposes

Unauthorized use may result in legal action.

5. Virtual Sessions

  • Access is limited to registered participants.

  • Sharing, recording, or distributing virtual sessions is prohibited.

  • Nine is not liable for technical issues outside its control.

6. Participant Conduct

Participants must behave respectfully. Disruptive, abusive, or inappropriate behaviour may result in removal from classes without refund.

7. Health & Safety

Participation in in-person sessions is at your own discretion. You must:

  • Disclose relevant health concerns

  • Follow all venue and safety instructions

Nine is not liable for injury, illness, or loss except where legally required.

8. Products

All products are subject to the Refund Policy and the Consumer Guarantees Act 1993 (NZ). Change-of-mind returns are not accepted. Faulty goods must be reported within 14 days.

9. Media Consent

By attending classes or engaging with Nine:

  • You consent to the use of photos, videos, or testimonials for marketing purposes.

  • If you do not consent, you must notify Nine in writing prior to attending.

10. Birth Outcome Disclaimer

Attendance does not guarantee any specific birth outcome or experience. Nine accepts no liability for the timing, method, or results of labour or birth.

11. Force Majeure

Nine is not liable for delays, cancellations, or rescheduling caused by circumstances outside its control, including:

  • Natural disasters

  • Hospital restrictions or closures

  • Public health emergencies

  • Other unforeseen events

Where possible, we will offer alternative dates or full refunds.

12. Limitation of Liability

To the maximum extent permitted by New Zealand law:

  • Nine is not liable for indirect, incidental, or consequential loss.

  • Liability for any claim arising from participation is limited to the value of the product or service purchased.

  • Nothing limits your rights under New Zealand consumer law.

13. Privacy

Nine collects personal information to provide services, process payments, and communicate with you. Information is handled under NZ privacy law.

We do not sell or rent personal information. We may share it only:

  • With service providers essential to delivering our services

  • Where required by law

  • With your consent

You may access, correct, or withdraw consent for personal data use at any time by contacting [Insert Email].

14. Amendments

Nine may update these Terms at any time. The version published at the time of booking applies.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of New Zealand. You submit to the exclusive jurisdiction of New Zealand courts.
